Terms of Service
Please read these terms carefully before booking. By securing a date with Makani Ā Wai, you agree to the following policies designed to ensure a safe and seamless experience.
1. Booking & Payments
- A 50% non-refundable retainer is required to secure your date and time.
- The remaining balance is due 7 days prior to your event date.
- Bookings made within 7 days of the event require full payment upon booking.
- All pricing is subject to Hawaii General Excise Tax (GET).
2. Cancellation & Rescheduling
We understand that travel plans change. Our policy reflects the custom nature of our work:
- 14+ Days Notice: You may reschedule your event to a new date within 6 months (subject to availability) with no penalty.
- 7-13 Days Notice: Rescheduling is permitted, but may incur a restocking fee for perishable goods already ordered.
- Less than 7 Days Notice: Cancellations are non-refundable. Rescheduling is at the sole discretion of management.
3. Weather Policy
Hawaii's weather is tropical and can be unpredictable.
- We monitor the forecast closely. In the event of heavy rain or hazardous conditions, we will work with you to reschedule or move the event to an indoor location (e.g., your vacation rental lanai).
- The decision to move or reschedule due to weather is made by Makani Ā Wai to protect our staff, inventory, and your comfort.
- Light tropical showers are common and do not constitute a reason for cancellation.
4. Location & Permits
All beach picnics are conducted in accordance with Hawaii State DLNR rules regarding commercial activity on public beaches. We cannot guarantee total privacy in public spaces, though we select locations to maximize seclusion. We strictly adhere to "Leave No Trace" principles.
5. Liability & Safety
By participating in our experiences, you acknowledge the inherent risks of outdoor activities, including but not limited to: uneven terrain, ocean conditions, insects, and sun exposure. Makani Ā Wai is not liable for injuries or lost personal property.
Food Allergies: It is the client's responsibility to disclose all dietary restrictions and allergies at the time of booking. While we take precautions, we cannot guarantee a 100% allergen-free environment due to open-air dining conditions.
6. Damages
You are responsible for the equipment during your event. Significant damage to furniture, textiles, or decor beyond normal wear and tear (e.g., wine spills on rugs, broken glassware) will result in a replacement fee billed to the card on file.
Makani Ā Wai is a registered trade name in the State of Hawaii.
